I. Introduction and Agreement to these Terms of Service

Welcome and thanks for your interest in the products and services of e-Ventures Elite (eVE). By accessing and using any application created by eVE (the “Apps”), you acknowledge that you have read, understood, and agree to the most recent version of these Terms of Service (“Terms”).
eVE reserves the right to revise these Terms at any time. If we do, we will post the modified Terms on this page and indicate the date of most the recent change above. You agree to read all notifications we send you and to periodically check this page for updates to these Terms. Your continued use of the Apps constitutes acceptance of these Terms and any modifications thereto. If you object to any changes, your sole recourse is to cease use of the Apps.
Since the Apps exist on the Facebook platform, any activities on Facebook beyond the scope of the Apps are governed by Facebook’s Statement of Rights and Responsibilities. You can find Facebook’s Statement of Rights here: http://www.facebook.com/terms-of-use.

II. License to Use

Subject to compliance with these Terms, eVE is granting you a non-exclusive, non-transferable, revocable limited license to access the Apps for your own non-commercial purposes only. You agree not to use the Apps for any other purpose. If you violate any of these Terms, we reserve the right to terminate your license without notice.

III. In-App Currencies and Goods

The Apps may include virtual, in-app currency (“Virtual Currency”), such as coins, cash, or points that may be purchased with “real world” money or tailored interactions with a third-party service. Virtual Currency may be used to purchase virtual, in-app digital items (“Virtual Goods”), exclusive services or redeemable “real world” products via third party services. Please note that eVE does not handle the transactions of any Virtual Currency. Third party payments provider handles all Virtual Currency transactions. By purchasing Virtual Currency in the Apps, you are bound by third party payments providers’ Terms of Use.
In addition to any third party obligations, it the following shall apply. In no way can Virtual Currency or Virtual Goods be redeemed for “real world” money, goods, or other items of monetary value from any party unless explicitly offered in the Apps. Transfers of Virtual Currency or Virtual Goods outside of the Apps are strictly prohibited. This means you may not buy or sell Virtual Currency or Virtual Goods for “real world” money or otherwise exchange items for value outside of the Apps.
You also agree that all sales of Virtual Currency and Virtual Goods are final. No refunds will be given by our third party payments providers or eVE. Other than a limited, revocable, non-transferable license to use the Virtual Currency or Virtual Goods in the Apps, you have no right in or title to such Virtual Currency and Virtual Goods. In the event that your account is terminated or suspended for any reason, in eVE’s sole and absolute discretion, or if eVE discontinues its Apps, you forfeit any and all Virtual Currency and Goods. eVE has the absolute right to manage, regulate, control, modify, and/or eliminate Virtual Currency and/or Virtual Goods as it sees fit in its sole discretion, and eVE shall have no liability to you or anyone for the exercise of such rights.

IV. Rights to Content

“Content” means all software, communications, images, sounds, and material perceived or made available from the Apps. It also includes any feedback, comments, or suggestions that you provide to eVE regarding the Apps. Unless otherwise specified in writing, all Content is owned, controlled, or licensed by eVE. All Content is copyrighted under Hong Kong copyright laws and/or similar laws of other jurisdictions, protecting it from unauthorized use. eVE, its logos, and the Apps’ names are trademarks of eVE and may not be used without eVE’s express written permission.
You agree that all Content, including but not limited to all accounts, characters created, Virtual Currency, and Virtual Goods acquired and developed during the course of the Apps, are the sole and exclusive property of eVE. eVE may use all Content for any purpose, including for commercial or promotional use without restriction or compensation to you. You agree not to copy, redistribute, publish or otherwise exploit any Content in violation of the intellectual property rights of eVE or any other third party.
If you are deemed to have retained any right, title, or interest to any portion of the Content, you agree to and hereby assign solely and exclusively to eVE all of your right, title, and interest in and to such Content, without additional consideration, under all applicable laws, in perpetuity. If such assignment is ineffective under applicable law, you hereby grant to eVE the sole and exclusive, irrevocable, sub-licensable, transferable, worldwide, royalty-free license to reproduce, modify, create derivative works from, publish, distribute, sell, transfer, transmit, publicly display, use, and practice such Content, and to incorporate the same in other works in any form, media, or technology now known or later developed. To the extent permitted by applicable laws, you hereby waive any moral rights or rights of publicity or privacy you may have in such Content.
eVE representatives may monitor certain Content in the Apps, but cannot monitor or prescreen all of the Content and do not attempt to do so. We have the right, but not the obligation, to edit, refuse to post, or remove any Content posted in the Apps that are deemed objectionable or violate these Terms or the spirit of these Terms, in our sole discretion and determination. If you encounter something you find objectionable and in violation of these Terms, you can bring it to our attention by contacting us. We do not assume any responsibility or liability for Content that is generated by users of the Apps. You bear the entire risk of the completeness, accuracy or usefulness of Content found in the Apps.
You acknowledge and agree that eVE may use built-in tracking features to obtain information regarding your use of the Apps, and agree that such information is deemed to be Content for all purposes under these Terms.

V. User Code of Conduct

Your use of the Apps is governed by certain rules (the “Code of Conduct”), maintained and enforced by eVE. It is your responsibility to know, understand and abide by this Code of Conduct. The following rules are not meant to be exhaustive and eVE reserves the right to determine which conduct it considers to be outside the spirit of the Apps and to take such disciplinary measures as it sees fit up to and including termination and deletion of the user’s account. The Code of Conduct governs all aspects of your interaction with the Apps, including but not limited to selecting your user name, posting messages to the Message Wall, writing reviews, interacting with other users, and otherwise accessing the Apps.
If eVE finds in its sole and exclusive discretion that you have violated the Code of Conduct, we can change or remove the violating item and/or suspend or terminate your access to and use of the Apps.

You agree that your use of and conduct in the Apps shall be lawful and you will not:

 

• transmit or post any content or language which, in eVE’s sole and absolute discretion, is deemed to be offensive, including without limitation content or language that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, sexually explicit, or racially, ethnically or otherwise objectionable, nor may you use a misspelling or an alternative spelling to circumvent the content and language restrictions listed above;
• communicate or post any user’s personal information, including but not limited to another user’s address, phone number, e-mail address, or credit card number, in the Apps without the use’s express written consent, except that a user may communicate his or her own personal information;
• violate the contractual, personal, intellectual property or other rights of any party, or promote or constitute illegal activity;
• make improper use of eVE’s support services or submit false reports of abuse or misconduct;
• disseminate, transmit, or attempt to upload viruses, Trojan horses, keyboard loggers, time bombs, adware, spyware, or any other malicious or invasive code of program;
• copy or adapt the Apps’ software including but not limited to Flash, PHP, HTML, JavaScript, or other code;
• reverse engineer, decompile, reverse assemble, modify or attempt to discover any software (source code or object code) that eVE created to generate web pages or any software or other products or processes accessible through the Apps;
• except as may be the result of standard search engine or Internet browser usage, use or launch, develop or distribute any automated system, including, without limitation, any spider, robot (or “bot”), cheat utility, scraper or offline reader that accesses the Apps, or use or launch any unauthorized script or other software;
• interfere with or circumvent any security feature of the Apps or any feature that restricts or enforces limitations on use of or access to the Apps or Content;
• participate in any action that, in eVE’s sole and absolute opinion, results or may result in an authorized user of the Apps being defrauded out of Virtual Currency or Virtual goods that the user has earned through authorized use in the Apps;
• sell the Apps or any part thereof including but not limited to Virtual Goods or Virtual Currency, user accounts and access to them in exchange for real currency or items of monetary value; or
• engage in cheating or any other activity deemed by eVE to be in conflict with the spirit or intent of the Apps.

VI. Minors

By accessing and using the Apps, you represent and warrant that you are at least 13 years old. If you are a minor over the age of 13, we recommend you seek consent from a parent or legal guardian before accessing the Apps. Some of the Apps are age restricted and require additional age authentication. You may not access these Apps even with parental consent and eVE reserve the right to terminate your access if found to be in violation on local laws and these Terms.

VII. Termination

We reserve the right to terminate or suspend your account or access to any or all of the Apps at any time and for any reason. It is within our sole discretion and determination to terminate your account for what we deem to be a violation or reach of these Terms. In the event that we terminate or suspend your account, you will have no further access to your account or anything associated to it. As stated above, you will not be entitled to a refund of any Virtual Currency or Virtual Goods acquired or developed during the Apps.

VIII. Privacy

eVE respects and protects the privacy of the users of its Apps. By accessing the Apps, you acknowledge and incorporate the Privacy Policy into these Terms. Please refer to EVE’s Privacy Policy here: http://....
 

Privacy Policy

EVE pays attention to your personal data. Please read our Privacy Policy, in order to be aware of what type of information we collect, how we use/store/transfer it. Your use of the application signifies your agreement with our Privacy Policy.
This Privacy Policy may be amended from time to time. These modifications will be notified to you on http://... You are invited to look at this page periodically. Your continued use of the application will signify your acceptance of the changes.
The app is served on the Facebook Platform, so your activity on the app may sometimes be ruled by Facebook Privacy Policy and not ours.
We, as developers, also respect Facebook Principle and Policies. You can read them on http://developers.facebook.com/policy/.

WHAT WE COLLECT

Firstly, the main aim of collecting personal data is to help us improve the user experience in the app.
We collect Personal Information. By Personal Information, we mean data that identify you, such as name, address, telephone number, email, etc. We will not ask for all these data, but we may need some extra Personal Information for payment.
We harvest these data from Facebook, from You and from third parties.
Facebook: When you access the App through Facebook, we may receive your basic account information (user ID, name, email, gender, birthday, current city, profile picture URL, and the user IDs of the user’s friends who have also connected with your application) from Facebook.
Please note again, that we abide by Facebook rules that manage the use of personal data.
You: You may want to share additional information with us. In that case, we may use the information you voluntarily give to us through the My Profile page. You may edit this information at any point in time.
Third Parties: We may call upon the services of third parties that may collect information about you. In that case, they may share these data with us, according to their own Privacy Policies. Please note that this Privacy Policy applies only for eVE, and that we are not responsible for Privacy Policies of other sites.
We also collect non-Personal Information. By non-Personal Information, we mean data that cannot identify you. Non-Personal Information can be linked to the app (ratings, reviews, length of access, activities, …) or to the general use ( Internet Protocol Addresses, Browser type, Browser Language, referring and exit URLs, number of clicks…).
We may use generated user content. This is the content you can publish through the app and that is visible by everyone (posts wall, sent messages, actions with other users,…). Please note, that if you post Personal Information on things like comment or wall, we cannot guarantee the protection of your information. So, be careful of the content you publish on public domain. We cannot guarantee the use of this information.
We and our third parties may use cookies in your browser. Cookies are small file texts stored in your hard drive, that identify you as unique user and that contain non-Personal Information, such as information about a particular login session. Those Cookies help us to improve the service, to know how many visitors came and how they interact with the app. They are also used to remember the site personal look. Note that you can disable cookies, thanks to the parameters of your browser. This can prevent you from accessing the app, or having all functions.
Special Note about Children
The app does not directly target Children under 13. According to Facebook Terms of Use, Children under 13 are not allowed to access Facebook Site.

We strongly recommend that Children between 13 and 18 ask their parents before sending any private information.

HOW WE USE COLLECTED DATA

Again, the aim of harvesting data is the improvement of our app.
We abide by Facebook rules concerning the use of data. So we will never share/sell/rent/transfer any Personal Information about you to any third party without your consent.
We use the collected information to improve the quality of our app. We use the statistics that we have, thanks to your Personal and non-Personal Information, to establish profiles of our users. Like that, the app evolves in the best way to fit with people’s wishes. In fact, it helps us to understand who uses the most and why and to adapt the app to provide the content people really like to view.
We will also use collected data to technically manage the application. For example, we may log your IP addresses to monitor the traffic. We will never disclose your IP to a third party.
Personal Information allows us to contact you, if we need to. It allows us to send you notifications. If you do not want to receive further notifications from us, you can opt out at any time.
You may provide us email addresses of your friends to invite them to the app. We keep these addresses for a while to contact them and remind them that they have been invited to the application. They can opt not to receive further mail from us, at any time.
We may disclose or access data about you if the law requires it (subpoena, court order, …) or if we have a good faith belief that it will avoid liability or fraud or to comply with legal process. This includes sharing data with companies or governments. eVE does not have to question such governmental process.

TRANSFER

In the event of an acquisition or merger, we may transfer your data to the new owner to keep the application working. Your information would be protected by any pre-existed privacy policy.

STORAGE, SECURITY AND MODIFICATIONS

We use means as secure as possible to protect your data. Data are stored in an external server protected behind a firewall.
For sensitive information such as credit card number or password, we use SSL encryption (Secure Socket Technology Layer).
However, while we strive to protect your Personal Information, no transmission on the Internet or electronic storage is 100% secure. Any information you share is at your own risk. We disclaim liability for any unauthorized access or damage into any data.
Please note, that you can at any time modify your personal information thanks to your Facebook Profile.

THIRD PARTIES POLICIES AND LINKS

We may post links to others sites on our app. We are not responsible for their activities and the way they use information. Please read their own privacy policies.
The content of the site may be served or hosted by other web sites. In this case again, the web sites have their own privacy policies.
Third party advertising companies serve ads on our site. We will not share data that can identify you personally. They may also use cookies or beacons (also called clear gifs) to manage the best their online advertising.
